Overview

This document has been designed to help our regulatory compliance customers navigate European Union automotive regulations. We hope this helps speed up your research. This is not a comprehensive guide. Rather, we have taken the approach of gathering documents that are core to the EC Whole Vehicle Type Approval process, some related documents, and some tips for researching this set of content.

What is Whole Vehicle Type Approval (WVTA)?

Whole Vehicle Type Approval is a legislative system. Before a vehicle is put on the market, the vehicle type is tested by a national technical service to see that it complies with a comprehensive set of requirements. Those requirements are set out in type approval directives.

A vehicle type that complies with the requirements may be sold and registered in the EU market and EU countries must recognize the type approval certificates issued in other EU countries.

A Certificate of Conformity must be delivered by the manufacturer for each vehicle. This allows the owner to register the vehicle.

Type Approval broadly covers three categories of vehicles: motor vehicles and their trailers, motorcycles, and tractors. Each framework directive contains a more detailed description of the categories in scope and the requirements that apply to each category.



Motor Vehicles and Trailers

Directive 2007/46/EC is the framework directive for the approval of motor vehicles and their trailers. The Directive has been amended many times since it was issued.

Directive 2007/46 is currently under review and a proposal is under consideration to overhaul the framework directive.



L-category Vehicles (Two and Three-Wheeled Vehicles and Quadricycles)

Regulation (EU) No 168/2013 establishes the technical and administrative requirements for the type approval of two and three-wheeled vehicles and quadricycles (L-category vehicles). This type approval regulation, which was adopted in 2013, repeals Directive 2002/24/EC (along with 14 other regulations). As of 1 January 2016, compliance with Regulation (EU) No 168/2013 is mandatory. Prior to 2016, manufacturers had been able to voluntarily request a vehicle approval on the basis of 168/2013.



Related Regulations include:

Regulation (EU) 901/2014 which establishes uniform conditions for the implementation of the administrative requirements for the approval of new two- or three-wheel vehicles and quadricycles, as well as systems, components and separate technical units designed and constructed for such vehicles. It also establishes the administrative requirements for placing on the market and entry into service of parts or equipment which may pose a serious risk to the correct functioning of essential systems.

Regulation (EU) 3/2014 establishes the detailed technical requirements and test procedures regarding functional safety for the approval and market surveillance of L-category vehicles and the systems, components and separate technical units intended for such vehicles in accordance with Regulation (EU) No 168/2013 and sets out a list of UNECE regulations and amendments thereto.

Regulation (EU) 44/2014 establishes the detailed technical requirements and test procedures regarding vehicle construction and general requirements for the approval of L-category vehicles and their systems, components and separate technical units intended for such vehicles in accordance with Regulation (EU) No 168/2013 and sets out a list of UNECE regulations and amendments thereto. It also establishes performance standards for technical services and the procedure for their assessment.

Regulation (EU) 134/2014 establishes the detailed technical requirements and test procedures regarding environmental and propulsion unit performance for the approval of L-category vehicles and the systems, components and separate technical units intended for such vehicles in accordance with Regulation (EU) No 168/2013 and sets out a list of UNECE regulations and amendments thereto.



Agricultural & Forestry Machinery

Regulation (EU) 167/2013 establishes the administrative and technical requirements for the type approval of agricultural and forestry vehicles designed and constructed in one or more stages, and to the systems, components and separate technical units, as well as parts and equipment, designed and constructed for agricultural and forestry vehicles. More details regarding the categories covered by 167/2013 can be found in Article 4 of the regulation.

Regulation 167/2013 allows manufacturers to apply, voluntarily, for whole-vehicle type-approval for all the categories covered by Regulation 167/2013 as of January 2016. The Regulation repeals the earlier type-approval regulation, Directive 2003/37/EC, which was more limited in scope. Additionally, Regulation 167/2013 simplifies the legislation, repealing 24 base directives.

Which UNECE Regulations have been adopted by the European Union?

Council Decision 97/836/EC lists the UNECE Regulations which have been adopted by the EC. Once adopted, these regulations are incorporated into annexes of the type approval documents listed above. The UNECE Regulations are also reprinted in the Official Journal of the European Union. More information can be found on RegNet Focus (see image below).



Where can I find a list of Technical Services and Type Approval Authorities?

The UNECE's Consolidated Resolution on the Construction of Vehicles (R.E.3) contains a list. Please see Annex I of this document (beginning page 353).
